School closing in Belgium: Belgian cross-border workers are eligible for family leave

Following Belgium’s decision to close primary and nursery schools from Monday 20 to Friday 24 December, one week before Christmas holidays in Belgium, cross-border worker parents will be able to request leave for family reasons (Congé pour raisons familiales-CRF).

The CRF’s request to the National Health Fund (CNS) must be accompanied by an official certificate from the school or the competent authority certifying that the child is attending school and that the closure as such is a measure to limit contamination with Covid.

A parent requesting leave for family reasons must inform his employer as soon as possible, either orally or in writing, indicating the start and end dates of the foreseen leave. The relevant form to request this leave with CNS is available on guichet.lu. It must be sent together with the supporting document to CNS (cns-crf@secu.lu) and to the employer. This leave is not counted against the legal days of leave for family reasons available by age group.

As a reminder, both parents (or spouses) cannot take the CRF at the same time. Employees who are placed on short-time work (chômage partiel) are not eligible. The child can be a child born in wedlock, out of wedlock, or adopted.

This provision is valid until December 18, 2021 inclusive, but should be extended until the end of February 2022 with the new Covid law passed on December 15.
